Using a fictional government RFP for a time travel machine as the starting point, we will lead the audience through a mock negotiation between the government, prime contractor, and subcontractor regarding the liability and insurance clauses in the prime and subcontracts for this RFP. The subject of the government RFP is fictional, but the liability and risk issues are relevant to the issues that government contract negotiators and attorneys grapple with every day. We will also use the negotiations as a platform to explain key considerations for how prime and subcontractors can limit their liability and protect their interests.
